Consignors Agreement

1. Pricing:   Pricing is set by Fashion Encore staff. Shop HAS THE RIGHT TO DISCOUNT ITEMS AT IT'S DISCRETION
WITHOUT NOTIFYING CONSIGNOR. THERE IS NO TIMEFRAME AS TO WHEN AN ITEM MAY BE DISCOUNTED. Fashion Encore has the right to manage , run it's business , price , run sales & discount items at our discretion.

2. Payment:  Forty Five percent (45%) of the final sale price shall be paid to Consignor and is available to consignor anytime
shop is open after the item has sold.  Payments are made only by request and not mailed.  It is consignor's responsibility to
request and pick up payment.  If payment is over $50.00 we request a 24 hour notice before picking up payment.

3. Liability:  Fashion Encore assumes no liability & is not responsible for the theft, loss, damage to or destruction of any item.

4. Imperfect Merchandise:  All items consigned are inspected as thoroughly as we can when item is consigned.  If it is
discovered the item(s) is/are dirty, damaged or otherwise unsuitable for placement on shop floor, item WILL BE DISCARDED
WITHOUT NOTICED TO THE CONSIGNER.  You need to make sure your items are in perfect condition before bringing them in.

5. Consignment:  Consigned items will be on the floor for 45 days provided the item remains in good condition & is still in the
current season. Consignor has the right to take back any consigned items at any time within the 45 day contract period.  If
consignor wants any items back it is the CONSIGNOR'S RESPONSIBILITY TO PULL & PICK UP ITEMS. Please do not ask or
expect shop staff to assist pulling items from racks.  It's not a requirement to pick up unsold items but the consignors choice
only if items are wanted. ANY unsold items not sold within a 45 day period & not picked up by consignor becomes to property
of Fashion Encore and can be sold or donated.  It is consigner's responsibility to pull & pick up any/all items.  Reconsigned
items must be pulled from the floor by the consignor and taken to the register area to be reprocessed with the new dates.
Consignment payments will be voided 180 days after agreement termination if consignment payment is not picked up.
